McDonald Footcare Privacy Policy  

Introduction

This Privacy Policy describes how and when we collect, use and share information when you attend an appointment at our clinics, purchase a product from us, contact us or otherwise use our services. This is to comply with the General Data Protection Regulations (GDPR) 2018.

Who we are:

McDonald Footcare is owned by podiatrist Lynn Mcdonald and we provide private podiatry services to the public. Our podiatrists are all self-employed professionals who are contracted to McDonald Footcare and abide by the professional standards of the profession and follow the business protocols adopted by McDonald Footcare. 

Information we collect and why we collect it

• Our patients information: 
To aid your treatment or as part of purchasing something from McDonald Footcare you will normally provide us with certain information, such as your name, email address, postal address, medical information and payment information.  
• Staff information
We hold employment data in accordance with Employment, Taxation and Pension law. 
• Contractors data
Data required for managing their contracts.
• Enquires via our website / Email enquiries / Business facebook page
These details are only used to provide you with information about the services which we provide or to enable us to deliver a service to you.

    Storage of your information

    The security of information is important to us and we endeavour to keep your personal data safe at all times. We adopt best practise methods to keep this information safe. We will store your information on an electronic patient record and diary system which is fully password protected. Any information held in paper form shall be stored securely in a locked filing cabinet. 

    We will do our upmost to keep your information safe but please remember there is no method of transmission via the internet, or electronic storage method that is 100% secure.

      Why we need your information and how we use it

      When you attend for your first appointment we will ask you to complete a questionnaire with a variey of personal and medical questions. All of the questions we ask are relevant to your treatment. We are bound by the Data Protection Act and are registered with the Information Commisioner. 

      We rely on a number of legal bases to collect, use, and share your information, including:

      • where it is necessary fo the purposes of the provision of health care as needed to provide our services, such as when we use your information to fulfil your podiatry assessment and treatment, or to provide customer support;
      • when you have provided your consent, which you may revoke at any time
      . • if necessary to comply with a legal obligation, court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law;

      Information sharing and disclosure

      Your data will only be used for the purposes of your medical records with us and we do not share this information with third parties unless agreed to by the patient (e.g. GP referral). As with all health and medical professions we are bound by patient confidentiality. 

      Information about our patients is important to McDonald Footcare. We share your personal information for very limited reasons and in limited circumstances, as follows:

      • Medical professionals. With your consent I will share information with medical professionals such as your GP or consultant to allow continuity of care. 
      • Business transfers. If we sell or merge McDonald Footcare, we may disclose your information as part of that transaction, only to the extent permitted by law and with your consent. 
      • Compliance with laws. I may collect, use, retain and share your information if I am legally required to. 

      Our staffs personal information is also important to us: Employment data will be shared with government agencies such as HMRC and accountancy firms who act on behalf of McDonald Footcare.

      Data retention

      We retain your personal information only for as long as necessary to provide you with the services as described in this Privacy Policy. However, we may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. 

      The retention of podiatry records is normally a minimum of 7 years, after the last appointment. For customers who are not patients but may have bought products from the business we will keep any data you may have provided for a minimum of 6 years in line with tax legislation. 

      Employment data will be stored for six years after an employee has left the practice and contractors data will be held for seven years after the contract has ended. 

      Any website enquiry data, facebook requests or email enquiries shall be deleted after 30 days or when the enquiry has been resolved.

      Transfer of personal information to outside of EU

      Where possible, we are committed to ensuring we store and process your personal information within the EU and ensuring the patient software fully complies with GDPR. We may also store and process your information through third-party hosting services in the US and other jurisdictions. As a result, we may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If we require to transfer information about you outside the EU, we rely on Privacy Shield as a legal basis for the transfer. 

      Your rights?

      You have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. We describe these rights below:

      • Access: You have the right to access and receive a copy of the personal information we hold about you by contacting us using the contact information below.
      • Change, restrict, delete: You may also have rights to change, restrict our use of or delete your personal information. In the case of health records these are normally exempt from change and deletion requests. 
      • Object: You can object to (i) our processing of some of your information based on our legitimate interests and (ii) receiving marketing messages from us after providing information unless we have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons. 
      • Complain: If you wish to raise a concern about our use of your information (and without prejudice to any other rights you may have), please contact us in the first instance to raise any concerns. You also have the right to contact the Information Commissioner www.ico.org.uk.

      Marketing & mailing lists

      At McDonald Footcare, we do not use your contact details to send direct marketing material, nor do not operate a mailing list. If either of these services are introduced in the future, your consent will be gained by opting into this service. We may use your information to contact you in certain circumstances which affect your appointments such as when there are changes which directly affect your appointments; When there is a change of practitioner, operational changes within our clinics or when our fee changes directly affect you.

      Updates or amendments to this Privacy Policy

      We reserve the right to periodically amend or revise the Privacy Policy; material changes will be effective immediately upon the display of the revised Privacy policy. The last revision will be reflected in the "Last modified" section. Your continued use of the Platform, following the notification of such amendments on our website, constitutes your acknowledgment and consent of such amendments to the Privacy Policy and your agreement to be bound by the terms of such amendments.
